Wyoming Judicial Branch Americans with Disabilities Act

The Americans with Disabilities Act of 1990 (ADA) was enacted to prohibit discrimination against people with disabilities. Specifically outlined in Title II of the ADA is the principle that no qualified person with a disability should face exclusion from participating in or be denied the benefits derived from public programs, services, or activities offered by a public entity. This legal mandate extends to the Wyoming state courts, positioned as providers of public programs, services, and activities. In accordance with the ADA, individuals with disabilities are entitled to an equal opportunity to access, utilize, and actively participate in court programs, services, and activities. The overarching goal is to ensure that no one faces discrimination based on their disability, fostering an environment of equal access.

The Wyoming Judicial Branch and the Wyoming Judicial Council are committed to ensuring equal access and comprehensive participation in court programs, services, and activities for all qualified individuals with disabilities.

The objective of this Policy is to guarantee equitable access and comprehensive participation for all individuals in judicial programs, court services, and court activities, while expressly prohibiting discrimination based on physical or mental disabilities.

Request for Reasonable Accommodations

Individuals seeking modifications to access court proceedings, programs, services, court records, or activities at the Wyoming Supreme Court, chancery court, any district court, or any circuit court are encouraged to submit a Request for Modification Form to the Statewide ADA Coordinator. While a written request for modification is preferred, individuals may also make the request by telephone to the Statewide ADA Coordinator. The Request for Modification Form is accessible through the link below, or can be obtained from various locations, including the Statewide ADA Coordinator, the Supreme Court Clerk’s Office, the Chancery Court Clerk’s Office, any district court judicial assistant, and any circuit court clerk’s office. Additionally, individuals can request the form in large print or other accessible formats as needed.

A request for modification may be submitted by any lawyer, party, witness, juror, or other individual interested in attending any court proceeding, program, activity or service or another person on behalf of such interested person.

The request for modification should be submitted to the Statewide ADA Coordinator with as much advance notice as possible.

Appeal Process

In the event that a Request for Modification is denied or if the offered alternate modification is deemed unsatisfactory by the applicant, an appeal process is available. The applicant has the right to appeal the decision of the Statewide ADA Coordinator to the Chief Legal Officer of the Administrative Office of the Courts within ten (10) days of receiving a written notification of the decision. This mechanism ensures that individuals have an avenue to seek further review if they are not content with the initial decision regarding their modification request.
